New Virginia House Bill 5106 – Landlords Cannot Take Action Against an Applicant Based on Payment History

The VA legislature passed House Bill 5106 which amends VA Code § 55.1-1245 effective March 1, 2021 through the later of 7 years after the expiration of the COVID state of emergency declared by the Governor or on July 1, 2028
The new law prohibits a landlord who owns more than 4 rental dwelling units from denying a rental application or taking any other adverse action against an applicant based solely upon payment history or an eviction for nonpayment that occurred during the period beginning on March 12, 2020 and ending 30 days after the end of the Governor’s COVID state of emergency declared by the Governor (the “Emergency Period”).
