The article highlights the concerns of LGBTQ+ individuals and couples as they face potential policy changes under the new administration. Lee, who has witnessed a significant increase in LGBTQ+ clients seeking legal counsel since the election, shares his perspective on the community's response to the uncertain political climate.
“People are very afraid,” Lee says, referencing fears that federal protections for same-sex marriage and other legal rights may be rescinded. He has advised committed but unmarried couples to consider marriage to secure their relationships. “The hope is that, even if the right to same-sex marriage is rescinded, marriages that are already legally recognized will remain intact,” he explains.
Lee also emphasizes the importance of proactive planning, including creating “defensive” estate plans that attempt to replicate the legal benefits of marriage, and utilizing Maryland's domestic-partnership registry as a potential safeguard.
