Peter E. Sayer represents clients in complex commercial, construction, and real estate matters, guiding them through disputes, transactions, and risk-management challenges throughout the life cycle of real estate development and ownership. His practice reflects a broad understanding of the legal, business, and practical considerations facing property owners, developers, and construction professionals, informed by experience in both the public and private sectors.
Peter works closely with property owners, developers, contractors, subcontractors, architects, engineers, and other design and real estate professionals to resolve disputes efficiently and strategically. He handles matters from inception through resolution, using negotiation, mediation, arbitration, and litigation to achieve practical and cost‑effective outcomes. His litigation experience spans construction and commercial disputes, distressed real estate matters, zoning and land use conflicts, and a wide range of real property issues.
In addition to dispute resolution, Peter regularly advises clients on property damage and personal injury claims, breach-of-contract matters, commercial and residential landlord‑tenant proceedings, and judgment enforcement. He has substantial experience with mechanics’ liens, including filing and foreclosure actions, RPAPL § 881 proceedings, and matters involving condominium and cooperative apartments, including nonjudicial foreclosure of cooperative units. His familiarity with these proceedings allows him to anticipate issues early and position matters for efficient resolution.
Peter maintains a robust transactional practice focused on protecting clients’ investments and minimizing risk. He routinely drafts and reviews contracts among owners, architects, engineers, contractors, and subcontractors, with particular attention to insurance coverage, indemnification provisions, defense obligations, intellectual property rights, and limitations on liability. He also prepares and negotiates license agreements between adjoining landowners to address building protection and access issues during construction. In addition, Peter regularly negotiates and drafts commercial leases and other real estate agreements, approaching each engagement with a collaborative and practical mindset.
Beyond individual matters, Peter serves as a trusted advisor to developers, owners, contractors, design professionals, lenders, and individuals seeking guidance on transactional planning and risk management. He provides counseling on sound contracting practices, insurance considerations, and site safety strategies designed to reduce exposure and support successful projects.
Peter appears regularly before New York State courts and various administrative bodies, handling matters from start to finish. His experience includes preparing pleadings, managing extensive motion practice and discovery, conducting hearings and trials, and handling appellate work. Throughout each engagement, Peter focuses on clear communication, strategic planning, and delivering value‑driven solutions aligned with his clients’ business objectives.
