Offit Kurman intellectual property attorney Laura Winston will lead a Table Topic discussion at the 2025 INTA Annual Meeting in San Diego on Tuesday, May 20. Laura's session, "Specimen Success: Proving Trademark Use before the U.S. Patent and Trademark," will dive into the requirements for proving "use in commerce" and offer practical guidance.
Trademark rights in the U.S. are dependent upon use in commerce, yet meeting the USPTO’s increasingly stringent standards can be a challenge. During her session, Laura will provide practical insights for demonstrating trademark use, addressing different types of filings such as the Statement of Use, Amendment to Allege Use, and Declaration of Use. Topics will also include specimen requirements for goods and services, with a special focus on web pages, packaging, and post-registration audits.
