Nine AEC Professional Associations Unite in Pennsylvania Supreme Court Case

A coalition of nine national and Pennsylvanian professional associations representing design professionals were included in an amici curiae brief with the Pennsylvania Supreme Court in the case of Aloia v. Diamant Building Corp. The brief filed on March 21, 2025, advocates for the affirming of the lower court's dismissal of the plaintiff’s claims, citing the Pennsylvania 12-year Construction Statute of Repose.

The brief, submitted by Anthony Potter, practice group leader of Offit Kurman's construction law practice group, underscores the vital interests of the design professions in upholding statutes that provide clarity and protection for architectural, engineering, construction (AEC) industry.  The organizations collectively support the uniform enforcement of the Pennsylvania Construction Statute of Repose, which ensures legal stability, avoids stale claims, upholds existing business policies including document retention policies and insurance maintenance policies.
