Niall McMillan

Counsel

Niall McMillan is a member of Offit Kurman’s Commercial Litigation Practice Group, where he represents businesses, commercial landlords, and individuals in complex litigation and business disputes. With a practical and solution-oriented approach, Niall is committed to helping clients achieve favorable outcomes while minimizing disruption and expense.

Niall’s practice spans a wide range of matters in federal and state courts, including business and contract disputes, commercial landlord and developer controversies, transactional litigation, and higher education proceedings and litigation. He is equally adept at representing clients in the courtroom and advising them proactively to avoid costly conflicts. His experience allows him to identify the issues most likely to affect a client’s case and tailor a strategy that balances risk, efficiency, and results.

Beyond litigation, Niall regularly counsels businesses on transactional and governance matters. He is a trusted advisor to his clients as they grow, operate, and sell their businesses. His transactional litigation experience gives him a unique perspective—bridging deal-making and dispute resolution to protect client interests at every stage of the business cycle.

Niall represents a diverse client base that includes publicly traded companies, regional businesses, nonprofit organizations, and individuals. He has a particular focus on advising and defending commercial landlords and developers, ensuring that property owners and managers are positioned to protect their investments while navigating tenant, vendor, and construction disputes and regulatory challenges. His Title IX work adds another dimension to his practice, where he provides thoughtful and zealous advocacy in highly sensitive matters involving investigations and disciplinary proceedings.

Before joining Offit Kurman, Niall honed his skills as a litigation and business law associate at a Bethesda-based firm. He also served as a mediator and client advocate with the American University, Washington College of Law’s Alternative Dispute Resolution Honor Society and ABA Mediation Competition Team, experiences that shaped his ability to negotiate effectively and advocate with precision.
