Janene M. Marasciullo is a principal attorney in the firm’s Commercial Litigation Practice Group. An accomplished, creative, and tenacious advocate, Janene has extensive first-chair experience litigating complex commercial, securities, RICO, fraud, business tort, trade secret and employment disputes, with an emphasis on disputes arising in the financial services and insurance industries. Janene also regularly defends clients facing SEC and FINRA investigations, qui tam litigation and IRS controversies. She has also assisted victims of criminal Ponzi schemes recoup their losses. Janene handled hundreds of cases, from inception through verdict and appeal, in federal and state courts throughout the United States and at FINRA Dispute Resolution and the American Arbitration Association. Janene is also a member of the American Arbitration Association’s Roster of Commercial Arbitrators.
Prior to entering private practice, Janene served as a trial attorney in the Civil Division and the Tax Division of the U.S. Department of Justice, where she represented the United States in complex contract, civil fraud, customs, regulatory and tax matters. Janene won multiple performance awards at DOJ, including the prestigious Special Commendation Award for the work on the largest government contract dispute in history. She also served as senior counsel in the Enforcement Department of NASD, the predecessor to FINRA, where she investigated violations of federal securities laws. While at NASD, Janene won the President’s Award for her work on the Mutual Funds Breakpoints Task Force. Janene also served as senior corporate counsel at a multinational conglomerate, where she managed the company’s litigation and compliance programs, and as the chair of the Securities Industry Practice at an AM 100 law firm. In addition, from 2023 to 2026, she was an adjunct professor of law at the Elisabeth Haub School of Law at Pace University, where she taught securities arbitration and supervised third-year students in the Investors Rights Clinic.
Janene draws on her extensive and varied experience to help clients solve their most challenging problems through negotiations, motions practice or trial. She is frequently asked to step into complex cases shortly before trial. In addition to her active litigation practice, Janene regularly counsels clients on compliance and risk management issues in the securities and insurance industries.
