Gerarda M. Culipher

Principal

Gerarda M. Culipher represents clients in trust and estate disputes, guardianship litigation, probate proceedings, and related appeals. Her practice focuses on helping beneficiaries, fiduciaries, personal representatives, trustees, guardians, and individuals acting under powers of attorney navigate complex inheritance and fiduciary matters throughout Virginia and the District of Columbia.

Gerarda handles matters involving will contests, trust disputes, allegations of undue influence, breach of fiduciary duty claims, incapacity issues, and beneficiary disputes. She also represents clients in probate and commissioner proceedings, as well as appeals arising from inheritance-related conflicts.

Drawing on more than a decade of leadership within the Fairfax Circuit Court Clerk's Office, where she served as Chief Deputy and Legal Counsel, Gerarda brings substantial knowledge of the court systems and legal processes that impact probate, fiduciary, and estate-related disputes. In that role, she oversaw legal and operational matters involving probate administration, civil litigation, real estate records, and other areas of law.

Before entering private practice, Gerarda clerked for The Hon. Loren A. Smith, United States Court of Federal Claims, and externed for The Hon. Louis Moore, Jr., United States District Court for the Eastern District of Louisiana, Magistrate Judge. She has also taught legal education courses and served as an adjunct professor of law, sharing her knowledge of Virginia courts, legal procedures, and developments in the practice of law.

Yet many firms underestimate how contracts, insurance, and internal practices intersect during a breach. This program offers legal and insurance perspectives on cyber risk in architecture, examining liability exposure, risky contract provisions, and mitigation strategies. A cyber insurance expert will explain policy responses, coverage gaps, coordination with professional liability, and best practices for aligning insurance with contractual risk and protecting firms from evolving cyber threats. Learning Objectives: Identify key cybersecurity and data privacy risks faced by architecture firms and explain how these risks can impact professional liability and project outcomes. Analyze common contractual provisions to determine which clauses may increase exposure to cyber incidents and propose strategies to mitigate these risks. Evaluate the scope and limitations of cyber insurance policies, including coordination with professional liability coverage, to determine how a policy would respond in a breach scenario. Develop actionable risk management strategies by integrating legal, contractual, and insurance considerations to protect sensitive client and project data.
