In its lengthy opinion on the 2013 case of Clemens et al v. New York Central Mutual Fire Insurance Company, the Court was outraged by the ethical breach and the “outrageously excessive” fees stemming from a failure to maintain contemporaneous time records and instead relying on one attorney to “’reconstruct’ records for every attorney, paralegal, or IT staff member billing time on this matter over an approximately six-year period.” This decision was appealed and then affirmed in September 2018. In this CLE, we will consider Clemens, define the terms “latency” and “velocity” as they relate to ethical timekeeping, and offer practical solutions to meet the ethical standards framed by RPC Rules 1.4 and 1.5 and these decisions.
