In Woods v. Martin, decided in late 2020 by the Virginia Supreme Court, the Court upheld a Fairfax Circuit Court decision awarding life insurance proceeds to a former spouse despite efforts of a bitter ex-spouse to thwart the terms of the parties' Property Settlement Agreement and divorce decree.

Offit Kurman attorneys Thomas W. Repczynski and Alison Noll, successfully argued the case to secure a $750,000 summary judgement and established new law in the process.

With the Supreme Court’s precedent-setting decision, Virginia now recognizes an ex-spouse’s “equitable assignment” rights to life insurance proceeds agreed to under a consensual property settlement agreement incorporated in a divorce decree.
