Decades ago, trademark practitioners frequently filed applications without conducting significant clearance. Often the primary resource was to contact a service that would conduct a manual search of the physical files of registration certificates at the U.S. Patent and Trademark Office (USPTO). Many were resigned to letting the USPTO conduct the primary search as part of the examination of the application. The first online databases became available in the late 1980s, and the resources have exploded since then. How do you determine when a search is needed? How do you develop a strategy for clearing a mark?
