Bethesda, MD | July 14, 2015 Offit Kurman attorneys Eric Pelletier and James Gaither have teamed up to introduce a new practice group for the firm. The introduction of the Legal Ethics and Attorney Representation group comes at a time when firms and attorneys alike are in constant need of representation for ethical matters. Whether it be a grievance or other forms of professional discipline, our attorneys have the resources and experience to handle any case, at any stage of the disciplinary process.

The Group’s attorneys have served as Assistant Bar Counsel, have served on and chaired Peer Review Panels, and have served as ethics counsel to Offit Kurman clients.

Some of the group’s areas of practice include:

  • Full service representation of attorneys who are facing potential bar discipline or are at risk of investigation by the Attorney Grievance Commission of Maryland;
  • Internal investigation including analysis of client files, accounts, and electronic data;
  • Assistance and representation in post discipline and re-admission matters;
  • Law firm departures, dissolution and breach of fiduciary duty claims;
  • Confidential advice pertaining to AGC/ethical issues;
  • Law firm formation;
  • Unauthorized practice of law;
  • Website audits/advertising;
  • Law practice and escrow account monitoring for conditional diversion agreements.

Timothy Lynch, Managing Principal of Legal Affairs states, “Over the years we have seen that the increase in litigiousness is not limited to civil lawsuits between clients.  When challenging economic times hit clients and when clients do not get the case results that they are looking for – more and more we see that clients are pursuing their attorneys in all manner of forums.  While there are a number of quality options for attorneys who get sued for malpractice, the same cannot be said for lawyers who get served with grievance.  The Legal Ethics and Attorney Representation practice group is comprised of experienced litigators with excellent repoire with the various attorney regulatory bodies.  Offit Kurman will not only be able to provide full-service representation to the Maryland bar and in the future, to several other jurisdictions, but should develop along with Offit Kurman to provide in-house best practices and compliance and ensure the protection of our firm and its employees.”
