Offit Kurman Attorney Represents Clients in $80M Bid Protest

VA awarded contracts for small business program support, both of which are being protested in federal court

The Department of Veterans Affairs awarded two contracts to meet requirements of its veteran-owned small business program — and both have since been protested in a federal court.

The VA awarded two contracts to Monterey Consultants Inc. of Dayton, Ohio, in September. One was valued at $41.6 million to provide support for the small business programs, and the other was totals $39.9 million to manage the VA’s Center for Veterans Enterprise.The latter includes processing contractor applications to be verified as veteran-owned, which in turn allows them to be able to compete for work set aside by the VA. Court documents for both cases were sealed to protect competitive information about the bids. But Offit Kurman attorney, the attorney representing the contractors for both cases, pointed to an alleged conflict of interest related to other work Monterey performs for the VA under different contracts, questions about Monterey’s status as a veteran-owned small business, and concerns about how the proposals were evaluated. “The bottom line is we’re alleging Monterey was picked long before the [request for proposals] was even released,” said Offit Kurman attorney, a principal at the Vienna office of law firm Offit Kurman who has written guest columns for the Washington Business Journal about contract protests. “It was wired.”
