The phone rings at 5 a.m. and it’s the communications director for the County School System. “Due to inclement weather, the School System has decided to close.” Every working parent’s nightmare!
There’s a Latin term called in loco parentis (which by the way does not mean that parents are crazy) it’s where custody transfers from one parent to the other at the beginning and end of the school day because the school has legal custody of the child during the day.
But what happens if unexpectedly there is no school?!
Many custody agreements that I prepare will address this situation and define when a visitation transition is to take place on a snow day.
Clients who have such a provision are not left wondering which of the two divorced or separated parents will need to take off of work or arrange for child care.
