Earlier this month, OHSA announced that it will delay enforcement of its silica rule for the construction industry for 90 days, which makes the new enforcement date September 23, 2017. The agency reasoned that more time is needed to, “secure additional guidance for the rule due to the unique nature of the requirements in the construction standard,” which requires employers to reduce workers’ allowed exposure to silica dust to 50 micrograms per cubic meter over an eight hour period.
Some expected the delay, as President Donald Trump promised to take a different approach to regulations than his predecessor and has already followed through by repealing certain regulations regarding violations. However, notwithstanding the delay in enforcement, OSHA stated that it expects employers in the construction industry to continue taking steps to ensure compliance by the new enforcement date.
