Question from Landlord: I’m planning to increase rent for the units at my apartment complex. Can I increase rent, and if so are there any restrictions for doing so?
Answer: Yes, you can increase rent following the completion of the lease term (ie. with a renewal lease) so long as you provide proper advance notice (usually 30 or 60 days pursuant to your lease) to all residents of the units where you will be increasing rent. No changes can be made to rent during the lease term unless all residents of a unit agree to the change in writing (however, note that in limited circumstances you may be able to increase rent during the lease term if permitted by HUD or VHDA). In addition, the decision to increase rent cannot be retaliatory in violation of VA Code § 55-248.39.
