Question from Landlord: We are conducting general maintenance on all of our apartment units. Can my maintenance team enter the apartments whenever they would like in order to conduct the maintenance or is some notice to the residents required?
Answer: At least 24-hours’ notice to the resident of the need to enter the dwelling and make the repair is required, and if pesticides or insecticides will be applied then at least 48-hours’ notice is required. If the resident himself requests a repair or the application of insecticides/pesticides, then you are not required to provide advance notice to the resident. Furthermore, advance notice also is not required in emergency situations.
This answer is specific to Virginia. Please call me for additional information if your property is located in Maryland or DC.
