Friday Factoid: “Making Available” Right Explained Under U.S. Law

Two treaties from the World Intellectual Property Organization require member states to recognize a copyright holders’ exclusive right to “make available” their protected works. This right gives authors and musical artists the exclusive right to allow others to transmit their protected works to the public via the Internet. The U.S. Copyright Office recently issued a report interpreting this right under U.S. law.
