Friday Factoid: Copyright Act Takes Priority Over Right of Publicity Claims
The U.S. Court of Appeals for the Eighth Circuit recently rejected an appeal of three former NFL players, who claimed the NFL’s use of their likeness in game films violated their rights under various state right of publicity laws. In its ruling, the Court held that the federal Copyright Act preempted their state right of publicity claims.
