Friday Factoid: Change to Procedure for Enforcing Copyrights Online

A federal Court of Appeals recently held that a copyright holder must first consider whether a posting based on its protected work constitutes a “fair use” (and is therefore permitted) before it sends a takedown notice to sites such as YouTube. This decision will likely change the landscape for the online enforcement of copyrights.
