The Weekly Scenario: Name on Birth Certificate Versus Name in a Will

Question:  If an individual’s name appears differently in the Will as the person’s birth certificate, is the Will still valid? Will this affect the ability of the Will to be properly probated? Answer:  If the individual is commonly known by the name used in the Will, then you should not have any difficulties. It is highly unlikely that anyone would come forward and challenge the name being different so long as the person can be identified If you have any questions or would like more information please contact Steve Shane at: sshane@offitkurman.com | 301.575.0313.
