Telebriefs®: The Intersection between FMLA & ADA

An issue that frequently arises is the overlap of the Family and Medical Leave Act (FMLA) and the Americans with Disability Act (ADA).  The FMLA grants 12 weeks of job protected leave. However, there are certain situations in which a person may be able to extend his 12 weeks of leave if he meets the ADA requirements. With recent amendments to the ADA, there are very few things that do not qualify as a disability resulting in a discussion whether or not additional leave is a “reasonable accommodation”.  An employer must grant additional leave, beyond the 12 weeks of FMLA leave, if such accommodations would not be an undue burden on the company. Depending on the circumstances, the employer may or may not be obligated to grant the leave.
