Maryland Jury Trial Waivers
The latest Maryland employment trend is to have employees waive their right to a jury trial. Such waivers can provide employers the best of both worlds — a judicial forum and no risk of a runaway jury verdict.

Employees Over Age 40

Jury trial waivers must comply with the Older Worker Benefits Protection Act (OWBPA). If an employee has an age discrimination claim that he/she wishes to bring in court, the employer can ensure that the jury trial waiver is enforced by including waiver language consistent with the Act. For example, before executing the waiver, the following language must be included in the waiver: (1) the applicant/employee must be given up to twenty-one (21) days to consider signing the waiver (although 21 days need not be taken); (2) either party may revoke the waiver within seven (7) days of execution; and (3) the applicant/employee is advised to consult with an attorney before signing this waiver.

Applicants Over Age 40

If an individual is applying to the company, the application should include language that an applicant is required to sign which states that he/she understands that execution of the waiver is required to be considered for employment and the applicant knowingly and voluntarily chooses to sign the Jury Trial Waiver.

Welcome Eric Pelletier, Esquire
Eric Pelletier is a partner in the firm’s Litigation Group. Mr. Pelletier received his Bachelor of Arts degree with honors from the University of Maryland in 1992. In 1995, he graduated from the Catholic University of America’s Columbus School of Law. Mr. Pelletier’s practice concentrates in complex civil litigation matters with an emphasis in disputes concerning businesses and business owners, general commercial litigation, professional malpractice, and employment litigation. Mr. Pelletier is a member of the Maryland and District of Columbia Bar Associations.

Settled nine (9) trademark infringement claims for a regional product manufacturer. Developed and implemented a proactive intellectual property protection program that detects trademark infringements.
Represented purchaser of the real property and car wash business in York, Pennsylvania.

Represented client in obtaining two favorable union arbitration decisions affirming the
termination of long-term employees.
Represented client in motion to disqualify a plaintiff’s attorney in Philadelphia. This effectuated a favorable client settlement.

Edward Snyder and Joe Crossney Join Offit Kurman
Edward Snyder joined Offit Kurman in August, 2005 as the firm’s Controller. Mr. Snyder’s
primary responsibilities include cash management, financial reporting, and supervising
the Billing Department.

Joe Crossney joined Offit Kurman in October, 2005 as Chief Administrative Officer,
with responsibility for all support personnel, processes, and facilities.

On February 2, 2006, Berman, Goldman and Ribakow welcomed Offit Kurman
to Howard County with a reception in its office.
