Real Estate for Cannabis Businesses

Offit Kurman Cannabis Attorney, Jason Klein, will host “Real Estate for Cannabis Businesses” with presenters Andrew Robinson and Tracie Clabaugh from Offit Kurman’s Real Estate Practice Group. Mr. Robinson will discuss the importance of performing zoning due diligence in connection with site selection and leasing of properties for all facets of the medical cannabis industry. He will specifically be covering issues related to working with government officials to develop and implement effective regulations, reviewing existing regulations where they exist, and what to expect during the development process. The discussion will be aimed at landlords, tenants, owners, operators, and investors in the industry and those interested in getting involved. Ms. Clabaugh will be discussing the importance of commercial lease provisions for the medical cannabis industry, and how these are different from typical commercial lease agreements. She will specifically discuss certain lease provisions, such as:
- (i) the definition of “permitted use”
- (ii) hours of operation
- (iii) access for landlord
- (iv) definition of “hazardous substances”
- (v) compliance with state and local rules
The discussion will be relevant to tenants, landlords, operators, owners, and investors.

Over the next few years, there are very few sectors of the economy projected to grow by triple-digits. Analysts are predicting the legal marijuana industry will grow 500% over the next five years. With growth comes a need for capital, but borrowing money in the Cannabis Space can be an onerous and challenging task.
Given marijuana’s federal illegal designation, many bank loans are hard to come by for cannabis shops. While financing is available, it is not cheap. Some would say that ten years ago, you’d have to go to a loan shark to fund a cannabis business and that lender may break your legs for missing a loan payment.
Cannabis attorney, Jason Klein, hosts this webinar with guest Michael Richardson from Summit Peak Credit. Michael has over 30 years of experience in mortgage loan production, valuation, quality control, compliance, forensics, fraud prevention and change management. With this knowledge, Michael was instrumental in developing the specialty lending platform for Summit Peak Credit, an Asset Based non-bank Lender for the Legal Cannabis Industry.
