Practice Focus

Mr. Davis’ litigation practice is concentrated in the representation of contractors and real estate developers, in both the residential and commercial settings. In addition to his transactional construction contracts practice, Mr. Davis’ litigation practice focuses primarily on construction litigation, condominium warranty litigation, mechanic’s lien actions, Miller Act claims, insurance litigation, surety litigation and real estate disputes. He serves as Chairman of the Committee to Retain the Sitting Judges of Montgomery County, Maryland Political Action Committee. Mr. Davis is also Co-host of the Montgomery County Bar Foundation’s Law School for the Public Television Show.

Points of Distinction

One of Mr. Davis’ most noteworthy cases was Wankel, et al. v. A&B Contractors, Inc., et al., 127 Md.App. 128, 732 A.2d 333 (1999), cert. denied, 356 Md. 496 (1999), in which Mr. Davis obtained summary judgment on behalf of a national homebuilder against claims arising from a natural gas explosion that destroyed a residence and damaged surrounding properties. In another recent case, Fosler v. Panoramic Design, Ltd., 376 Md. 118, 829 A.2d 271 (2003), Mr. Davis successfully litigated the issue of the primary jurisdiction of the Maryland Home Improvement Commission to determine whether a construction manager was performing a home improvement within the meaning of the Maryland Home Improvement statute.

Activities

Mr. Davis serves as Chairman of the Committee to Retain the Sitting Judges of Montgomery County, Maryland Political Action Committee as well as Co-host of the Montgomery County Bar Foundation’s Law School for the Public Television Show.

Prior to joining Offit Kurman, Mr. Davis was a partner in the Litigation Department of the Rockville law firm of Shulman, Rogers, Gandal, Pordy & Ecker.
