Robert R. Axenfeld is a registered-patent attorney, and assists clients with intellectual-property (IP) matters throughout the United States and worldwide.  He has over two decades of in-house and private-practice experience in obtaining, litigating, and licensing patents, trademarks, copyrights, domain names, trade secrets, and other IP.

Robert has extensive experience assisting clients before the United States Patent and Trademark Office, including patent-application preparation and prosecution, trademark and service mark registration, trademark cancellation and opposition proceedings before the Trademark Trial and Appeal Board, and patent appeals before the Board of Appeals and Interferences.

He also has significant experience litigating patent, trademark, unfair competition and other IP cases throughout the United States.  Robert also has substantial experience reviewing, negotiating and drafting licenses and technology agreements.  Examples of such agreements include: patent licenses, software licenses, web-based agreements and policies, master-services, joint development, technology-transfer, marketing, manufacturing, distribution and development agreements.

Points of Distinction

Robert has successfully litigated patent, trademark, and copyright infringement cases in federal court, as well as represented clients in trademark proceedings before the United States Patent and Trademark Office’s Trademark Trial and Appeal Board.  In one case, Robert discovered witness tampering on the part of an officer of a publically-traded company.  The discovery led to sanctions in excess of $1M dollars being awarded against the publically-traded company, and in favor of his client.  Other substantial successes (as either lead counsel or lead-patent counsel) include successfully defeating a motion for preliminary injunction for patent infringement against print-control companies, successfully defending ophthalmic-surgical-device companies against multiple patent infringement cases, and dismissing a trademark infringement action against an author and radio host.  In addition to IP litigation successes, Robert also served as in-house counsel to Unisys Corporation and Lucent Technologies, Inc., where he worked on over 100 intellectual property agreements and licenses.

Previous-Judicial Experience

While attending law school, Robert clerked as an Extern for the Honorable Alan D. Lourie of the United States Court of Appeals for the Federal Circuit.  He also interned for the Honorable Judge Martin F. Loughlin, and James R. Starr, Clerk of Court, both of the United States District Court, for the District of New Hampshire.
