Practice Focus
Mr. Monahan provides strategic counseling and advice to clients in the areas of commercial litigation, business formation and governance and real estate law. Mr. Monahan represents clients in various business matters and disputes, and also provides business advice to companies and individuals regarding business transactions and disputes. Mr. Monahan’s litigation practice is focused on complex business disputes, including corporate and partnership disputes, business torts, employment, construction and real estate litigation. In addition, Mr. Monahan works with clients in evaluating their estate planning needs and preparing the appropriate estate planning documents tailored to each client’s situation, from simple wills to more complex trust agreements.

Mr. Monahan helps clients strategically assess business issues and transactions, often with the goal of avoiding, or positively positioning for, future litigation. He has assisted clients in expeditiously and successfully resolving business disputes, and negotiated numerous business agreements, including settlement agreements in business matters in which a business resolution was achieved instead of litigation. Mr. Monahan has served various and diverse clients including technology companies, manufacturers, retailers, real estate developers and investors, lenders, general contractors, subcontractors, and medical and veterinary practices.

Points of Distinction
Mr. Monahan has represented a founder of a business in successfully defending a fraud and breach of contract claim seeking over $25 million in damages from his client. He has represented franchisees in breach of franchise agreement cases, and recently obtained rescission on behalf of a business owner who had been defrauded by his business partner. Mr. Monahan has represented clients in NASD arbitrations, and also successfully defended a claim for back charges against a subcontractor seeking over $1 million. He has represented real estate developers and home builders in multi-million dollar contract disputes and various businesses in employment matters, including restrictive covenant and non-solicitation agreements. Mr. Monahan is a licensed Maryland Real Estate Broker and is a neutral arbitrator on the NASD Arbitration Panel. He is a member of both the Maryland State Bar Association and the District of Columbia Bar Association.
